PlaySpark Returns, Refunds and Warranty Policy

Effective Date: 01 July 2026

This Returns, Refunds and Warranty Policy applies to all purchases made from PlaySpark.

1. General Policy

At PlaySpark, we want you to be satisfied with your purchase. However, because our products are electronic devices and consumable accessories may be used, returns are accepted only in accordance with this policy and applicable South African law.

Nothing in this policy limits or excludes any rights that consumers have under the Consumer Protection Act, 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act, 25 of 2002 ("ECTA"), or any other applicable law.

2. Change-of-Mind Returns

Except where required by law, PlaySpark does not accept returns or provide refunds because:

  • You changed your mind;

  • You ordered the wrong item;

  • You no longer want the product;

  • The product was purchased as a gift and is no longer wanted; or

  • You found the product cheaper elsewhere.

Any acceptance of a change-of-mind return is entirely at PlaySpark's discretion.

If PlaySpark chooses to accept a discretionary return:

  • The request must be made within 7 calendar days of delivery;

  • The product must be unused, undamaged, complete, and in a resalable condition;

  • The product must include all accessories, manuals, packaging, inserts, and proof of purchase;

  • The product must not have been registered, modified, damaged, or show signs of use beyond reasonable inspection;

  • The customer is responsible for all shipping and insurance costs; and

  • PlaySpark may deduct reasonable handling, restocking, cleaning, testing, repackaging, or restoration costs where permitted by law.

Products showing signs of use, wear, damage, abuse, alteration, or missing components may be refused or may qualify only for a partial refund.

3. Consumables and Accessories

For hygiene, safety, and quality-control reasons, PlaySpark may refuse returns of:

  • Opened filament packs;

  • Custom-made or special-order products;

  • Downloadable digital products;

  • Gift cards or vouchers;

  • Products that have been modified or personalised; and

  • Any item that cannot reasonably be resold as new.

This limitation does not apply where the product is defective or where applicable law requires otherwise.

4. Defective Products

Under the CPA, consumers have an implied warranty of quality for certain defective goods.

If a product is defective, unsafe, fails to operate as intended under normal use, or does not meet the standards required by law, you may be entitled to a repair, replacement, or refund as provided by the CPA.

The following are not considered defects:

  • Damage caused by misuse, negligence, abuse, accidents, improper storage, or failure to follow instructions;

  • Use of incompatible accessories, chargers, adapters, or third-party power supplies;

  • Commercial or industrial use where the product is intended for hobby or household use only;

  • Normal wear and tear;

  • Cosmetic damage occurring after delivery;

  • Damage caused by children using the product without adult supervision;

  • Damage resulting from modification, repair, dismantling, or attempted repair by unauthorised persons;

  • Damage caused by using unsuitable materials, foreign objects, or non-recommended filament.

Where a returned product requires inspection, testing, or diagnosis, PlaySpark may first examine the product to determine whether a defect exists and whether the defect is covered by law.

If inspection shows that the product is not defective or that the issue arose due to misuse, abuse, accidental damage, or other excluded circumstances, the customer may be responsible for return shipping and any reasonable inspection costs permitted by law.

5. 3D Pen Safety and Intended Use

PlaySpark 3D pens contain electronic and heated components and are intended solely for their designated purpose.

Users must read and follow all instructions and safety information provided.

  • Adult supervision is recommended for children under the age of 14 years.

  • The nozzle and melted filament can become hot during use and may cause burns if handled improperly.

  • The product should only be used with compatible materials and accessories recommended by PlaySpark.

PlaySpark is not responsible for:

  • Injuries resulting from misuse or improper handling;

  • Burns caused by failure to follow instructions;

  • Damage to property caused by negligent use;

  • Damage arising from modifications or unauthorised repairs; or

  • Damage caused by use of incompatible materials or accessories.

Nothing in this section excludes liability that cannot legally be excluded under South African law.

6. Incorrect or Damaged Deliveries

If you receive:

  • The wrong product;

  • An incomplete order; or

  • A product damaged during delivery,

you must notify PlaySpark within 48 hours of delivery and provide photographs and proof of purchase where reasonably requested.

PlaySpark reserves the right to inspect, collect, replace, repair, or refund the product in accordance with applicable law.

7. Online Orders and Cooling-Off Rights

Where a consumer has a statutory cooling-off right under ECTA or other applicable legislation, the consumer may exercise that right within the legally prescribed period.

The customer remains responsible for the direct cost of returning the goods unless applicable law provides otherwise.

Returned products must be returned in substantially the same condition in which they were delivered, subject only to reasonable inspection.

  • Order number;

  • Full name;

  • Description of the issue;

  • Photographs where applicable; and

  • Proof of purchase.

Returns sent without prior authorisation may be refused.

9. Refund Processing

Approved refunds will be processed using the original payment method unless otherwise agreed.

Refunds:

  • Do not include original shipping fees except where required by law;

  • May be subject to reasonable deductions permitted by law; and

  • Will only be processed after the returned goods have been received and inspected.

10. Limitation of Liability

To the maximum extent permitted by law:

  • PlaySpark's liability is limited to the repair, replacement, or refund remedies available under applicable consumer legislation;

  • PlaySpark is not liable for indirect, incidental, special, consequential, or economic losses, including loss of profits, loss of business, loss of data, or loss arising from inability to use the product;

  • PlaySpark is not liable for damage resulting from misuse, negligence, modification, unauthorised repair, improper storage, or failure to follow instructions.

Nothing in this policy excludes, restricts, or limits any rights or remedies that cannot legally be excluded under South African law.

11. Governing Law

This policy is governed by the laws of the Republic of South Africa and shall be interpreted in accordance with applicable South African consumer protection legislation.
